SC Seeks Urgent Filing of Vacant Posts in ITAT
On 26 May 2026 (Tuesday), the Supreme Court issued notice over the long-pending vacancies in several posts at the Income Tax Appellate Tribunal (ITAT). The court also directed various high courts to send judicial officers on deputation to meet the requirements.
A bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi sought a response from the Centre after hearing a PIL filed by an ex-vice president of the ITAT, Parveen Kumar Bansal.
The court also sought assistance from Attorney General R Venkataramani on the matter.
The bench said, “A petition is to be supplied to the office of the Attorney General to ensure that the unfiled posts are filed at the earliest in the Income Tax Appellate Tribunal.” As a stopgap measure, tribunals may request HC to send judicial officers on deputation where such officers can be spared.”
Senior advocate Mukul Rohatgi, representing the petitioner, told the court that key positions in the Income Tax Appellate Tribunal, including registrar posts, have been vacant for several years.
The Supreme Court of India expressed surprise over the long-pending vacancies in these posts and assured senior advocate Mukul Rohatgi that the issue would also be examined on the administrative side.
