Professional Misconduct: ICAI removes name of CA Anil Mittal from Register of Members involved in Amrapali Scam ICAI observed that CA Anil Mittal (The Respondent) has been alleged for his professional work in respect of thirty four companies of Amrapali Group. It is noted that there are Amrapali Group Companies, the Registered office of which is the premises of the Respondent. Further, his office boy cum assistant is the director of many Group companies. Some of the companies have also paid money to the certain entities in which the Respondent was interested. In fact, the Respondent along with CFO of Amrapali Group of Companies were partners in Saffron Consultants LLP and as per the statement of Mr.i Pankaj Mehta, ex-Company Secretary (A-613 & A-614), they were controlling the affairs of Amrapali Group of Companies. The Respondent has been charged to have connived with CFO of Amrapali Group to manipulate the accounts. The act committed by the Respondent is highly unbecoming of the chartered accountant. The Respondent is completely silent on all these aspects and claiming that all professional duties to various Group companies were rendered with high degree of integrity and independence. On review of all the matters it was observed that the Respondent had failed to disclose material facts, in fact, he failed to report the material misstatement that existed in the financial statements. In the absence of working papers, it is also evident that the Respondent has failed to obtain sufficient audit evidence to express opinion on financial statements. Click here to read the Order
