ROC Filing FY 2021-22: Due Date Extension Update
The Due date for Filing form AOC-4 for FY 2021-22 is 30 Days from the Annual General Meeting (AGM) date. Now, Most of the Companies Show, on 30th September 2021, as their AGM, the Due date for Filing Stands to be 29th Oct 2022.
Professionals have complaint about various problems that they are facing on MCA Portal.

Also, there is no provision of Revision of AOC-4 if wrong Data is submitted.
Give us the opportunity to file NIL AOC 4 with a provision to revision. 100% filing will happen.

The Institute of Company Secretaries of India(ICSI) in its representation quoted that the Central Board of Direct Taxes (CBDT) on consideration of difficulties faced by the taxpayers and other stakeholders, has vide circular No. 19/2022 dated 30.09.2022, granted 7 days extension for the filing of audit reports for the Assessment Year 2022-23 i.e. from 30th September 2022 to 07th October 2022 for filing of various reports of audit for the Assessment Year 2022-23. So, in the majority of cases, the audited figures are made available after 7th October 2022.
Further, the instituted added that a number of communications are being received from our stakeholders requesting an extension of the last date for filing of financial statements as well as citing the fact that the dates of filing financial statements is coinciding with the varied festivals (Diwali, Bhai Dooj, Chhath Puja, etc.) celebrated across the length and breadth of the nation, during which corporates and professional workspaces are closed temporarily.

During this period, there is a lack of manpower and support staff which add to the woes. Amid festivities, with having few days for fitting, the stakeholders are requesting for such extension of the last date for filing of financial statement.

Consequences of Non-Filing within the Due Date are Additional Fees of Rs. 100 per day w.e.f. 30 October will be levied and Penalties from Rs. 10,000 to Rs. 2 lakh can be levied.
