High court criticizes Income Tax Department for not releasing ITR Utilities despite 11 years of directions

Gujarat High Court in matter of CHARTERED ACCOUNTANTS ASSOCIATION, SURAT (CAAS) & ORS. vs UNION OF INDIA & ORS. has criticized Income Tax Department for not releasing forms and utilities for e-filing of income tax returns on the 1st day of April of the relevant assessment year.

For Assessment Year 2026-27 (Financial Year 2025-26) ITR Forms have been released, but ITR utilities are still pending to be released. “Even after the passage of 11 years, the respondent-Department is not adhering to such directions” the court said while listing the matter.

In the present writ petition, the petitioner, CAAS has raised very serious issues relating to the functioning of the respondent-Department and the hurdles faced due to non-compliance with the orders of this Court as well as due to the lack of proper technical monitoring of the portal.

This matter is listed on 27.04.2026 for further hearing.
