To
All Principal Chief Commissioners of Income Tax,
Sub: Suggestion on Litigation Management - reg.
Madam/Sir,
Kindly refer to the Judicial Conference on Litigation Management held in Delhi on 04.01.2019.
2. One of the issues flagged during the conference was that many a times, linkage of some cases to the AOs is difficult causing delay in SLP proposals and it was suggested that a list of a ll appeals pending with High Courts along with AO's jurisdiction and PAN should be maintained.
3. In this regard, I am directed to state that it shall be the responsibility of the concerned High Court Cell and PCIT to identify the jurisdiction and comply with the time limits for filing of appeals. It is suggested that files should be reconstructed with the help of High Court Registry in cases where AO is not identified and the records are not available.
4. This issues with the approval of Member(A&J), CBDT.
Yours faithfully,
Abhishek Gautam
