Govt Notifies Delegation of Approval Powers Under Section 100 of the Industrial Relations Code, 2020
The Ministry of Labour and Employment recently issued a notification (No. S.O. 2323(E)) on May 08, 2026, regarding the delegation of powers under the Industrial Relations Code, 2020.
Under Section 100 of the Industrial Relations Code, 2020, the Government is allowed to delegate its powers to other officials. Using this provision, the Government has authorised officers who are of the rank of Joint Secretary or higher and who handle Industrial Relations matters to act on its behalf.
These officers can now examine and decide applications related to lay-offs, retrenchment, and closure of establishments. This applies in cases where the Central Government is the "appropriate government" responsible for granting approval under Sections 78, 79, and 80 of the Code.
