High Court Allows Plea to Condon 44-Day Delay Due to Wife's Medical Emergency
The court has allowed an application seeking condonation of a 44-day delay in filing a review application.
Background of the Case
The present case has been filed by Sanjay Jagdishbhai Bhaty against Kandla Port Trust, seeking condonation of delay of 44 days in filing the captioned application.
During the hearing, the applicant stated that the delay occurred due to his wife’s ill health. He stated that he was occupied with her treatment and follow-up care, which caused the delay in submitting the application.
On the other hand, the respondent's advocate argued that the delay had not been properly explained and should not be condoned. He also informed the court that the related Letters Patent Appeal No. 1077 of 2021 is scheduled for hearing on March 17, 2026.
High Court's Ruling
After considering all the circumstances and facts, the high court found the explanation satisfactory and decided to condone the 44-day delay.
The High Court said this decision does not mean the applicant can ask for more delays in the future or refuse to cooperate during the appeal process.
Lastly, the court stated that the appeal would be heard and decided on its own merits.
As a result, the court allowed the application and directed the registry to assign a regular number to the appeal and place it before the appropriate bench as per the roster.
