According to the GST department, IRCON claimed and used input tax credit of Rs 72,41,05,710 on invoices related to works contract services provided by its subcontractors. The department has asked the company to explain why the tax credit should be considered valid.

The matter came up for hearing before Uttarakhand High Court on 26 October, 2026. The court during the hearing directed the GST department to submit its reply within four weeks and asked IRCON to give its reply to the show-cause notice within two weeks.

The court also asked the GST authorities not to pass any order in the matter till the next hearing. Thus the case is still pending and the court has not yet reached a final decision on the issue.
