Penalty for late filing of AOC-4 for FY 2021-22
As per the Companies Act, the professionals are required to Submit Audit Reports, Audited Financials, and Directors Report with the Registrar of Companies (ROC) within 30 Days of the Annual General Meeting (AGM).
Upto When AGM can be Shown?
As per the Companies Act, the AGM has to be completed within six months from the end of the financial year, and that the gap between AGMs of 2 consecutive years is not more than 15 months. Now, Most of the Companies Show AGM on 30th September 2021, the Due date for Filing Stands to be 29th Oct 2022. As per the Companies Act, 2013, an additional fee of Rs. hundred per day is to be levied after the Due Date, i.e. from 30th Oct 2022, the AOC-4 will be filed with Late Fees of Rs. 100. In Worst Circumstances, Penalties of Rs. 10,000 to 2 lakh can also be levied along with conviction and imprisonment of Directors, Managing Director or Cheif Financial Officer of the company.
