ROC Chandigarh Imposes Penalty on Director for Holding Two DINs
The Registrar of Companies (ROC) Chandigarh imposed a Rs 50,000 penalty on director Raj Sharma for violating Section 155 read with Section 159 of the Companies Act 2013. In the present case, the director had two Director Identification Numbers (DINs), whereas according to the law, a person should have only one DIN. As per records, he had earlier taken one DIN on February 17th, 2012, and later took another DIN by mistake on April 28th, 2023. Raj Sharma, on his part, said that this mistake was not done intentionally, but unknowingly. He also said that no one was harmed by this. As soon as he came to know about this, he immediately applied for rectification to surrender a DIN through e-Form DIR-5 on November 8th, 2024. Apart from this, he himself admitted his mistake by filing an application under Section 454 and also demanded some relief. After investigating the matter, ROC admitted that even if the mistake was unintentional, having more than one DIN is a violation of the law. Therefore, he was held responsible for this. Ultimately, Raj Sharma was fined Rs 50,000 and directed to follow all the rules properly henceforth. Payment will have to be made through the online “e-Adjudication” portal. If Raj Sharma does not agree with this order, he can appeal before the RD (Chandigarh) within 60 days.
