Supreme Court dismisses Petition challenging pattern of CMA Exams; Exams set to be held online

The Supreme Court of India dismissed the Petition contesting the pattern of the Intermediate and Final CMA Exams, which were intended to be held online.

Nitin, one of the petitioners, requested that the pattern of the Intermediate and Final Exam 2021 be declared illegal, null and void since it violates Article(s) 14, 19, and 21 of the Indian Constitution and thus void ab initio.

The petitioners objected to the examination pattern for the following reasons: The institute has changed the pattern ad hoc, without providing any official notification on their official websites about changes in exam patterns.

The institute has modified the exam pattern three times in the last month, causing a lot of confusion and mayhem in the minds of the candidates.

According to the study material published by the Institute, the latest pattern or exam mode issued by the Institute is not at all practicable. The recent trend indicates that a lot more typing of responses will be necessary, for which applicants are not yet prepared or rehearsed. Practical issues, such as theory papers with lengthy responses based on the most recent pattern, will be impossible to complete in the allotted time. The Institute has set a time limit of 3 hours, which would make it impossible for students to complete the exam because the majority of candidates are well versed and practised in writing on pen and paper.

According to the current test pattern, the authorities are taking away the fundamental rights of Hindi Medium applicants because it is not possible to type responses to subjective questions in Hindi in a time limit of three hours.

While dismissing the petition, the three-judge bench of Justice LN Rao, Justice BR Gavai, and Justice BV Nagarathna stated, “We cannot convert ourselves into supervisory authority.”
