Waiver of Late Fees enabled on GST common portal for those who could not file GSTR1 and GSTR3B for the period July – September, 2018 – now to file after 22nd Dec, 2018 by 31st March, 2019

For Example if my return for the month of April 2018 is pending, the GSTN portal is showing its due date as 31st March 2019.

This means that no penalty will be levied if the return is filed before 31st March 2019. However interest of late payment of GST will be calculated at the rate of 18% p.a. and is required to be paid to the Government as per section 50 of Central Goods and service Tax Act 2017.

The decision of waiving GST late fees for those who could not file GSTR1 and GSTR3B for the period July – September, 2018 was taken in 31st GST Council meeting.

This decision was notified by Notification No. 76/2018 Central Tax dated 31st December, 2018.

An important thing to note here is that this waiver is only for the tax payers who have not filed there GSTR1 and GSTR3B for the period of July to September, 2018 by 22nd December 2018. Only these taxpayer will get the waiver if they file the return upto before 31st March 2019.
