Central Government Announces New Changes to Patent Rules for 2025
The Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) recently shared a notification on November 25, 2025 regarding amendments in Patent Rules 2003.
The government proposed some changes to the Patents Rules, 2003. As required by law, they published a draft of these changes on July 16, 2025 in the official government publication (the Gazette of India). They also announced that anyone who might be affected by these changes could send their objections or suggestions within 30 days from the date the Gazette was made available to the public.
The government made the draft changes to the Patent Rules available to the public on July 16, 2025. People sent in their comments and objections, and the government has reviewed all of them.
Now, using its legal authority under the Patent Act, the government is officially making the new amendments to the Patent Rules, 2003. Following are the new amendments:
1. These rules will be known as the Patents (Amendment) Rules, 2025.
2. In the Patent Rules, 2003 for chapter XIV A, the following chapter will be replaced:
107A. Definitions. - In this chapter, unless the context otherwise requires, -
(a) "adjudicating officer" refers to an officer authorised under section 124A of the Act;
(b) "appellant" refer to a person aggrieved by an order of the adjudicating officer and who prefers an appeal before the appellate authority under sub-section (1) of section 124B of the Act.
(c) "appellate authority" refers to an officer authorised under subsection (1) of section 124 B of the Act.’
Note: The Patents (Amendment) Rules, 2025 will come into force on the date of their publication in the Official Gazette.
