DGTR Initiates Sunset Review on Anti-Dumping Duty for Fluoroelastomer (FKM) Imports from China PR
The Directorate General of Trade Remedies (Ministry of Commerce and Industry) recently issued a notification on October 29, 2025 regarding anti-dumping duty on imports of 'Fluoroelastomer' (FKM).
Having considered the provisions of the Customs Tariff Act, 1975, as updated from time to time, and the Customs Tariff (Identification, Assessment and Collection of Anti-Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as updated from time to time (referred to as the “Rules”), the authorities have noted the laws that guide how anti-dumping investigations are started, carried out, and decided under the Act and the Rules.
The Designated Authority received an application from Gujarat Fluorochemicals Limited seeking initiation of a sunset review for extension of the present anti-dumping duty imposed on imports of Fluoroelastomer, originating in or exported from China PR.
Based on the earlier evidence provided by the applicant, the Authority issued a public notice (Notification No. October 7, 2025-DGTR dated June 16, 2025) published in the Gazette of India. The investigation was conducted under Section 9A(5) of the Act and Rule 23 of the Rules.
The main objective of this investigation is to find out whether ending the current anti-dumping duty would cause dumping and injury to the Indian industry to continue or happen again and whether the duty needs to be continued.
