Income Tax Department Recruitment 2023: The Office of the Commissioner of Income Tax, Judicial, Kolkata has issued a notice inviting applications for the empanelment of Senior and Junior Standing Counsels to represent the Income Tax Department before the Hon’ble Calcutta High Court and other judicial forums. The empanelment will be in accordance with CBDT Instruction No. 7/2016 dated 07.09.2016 and subsequent modifications. As per Income Tax Department Recruitment 2023 official notification, advocates of substantial standing and repute, with good academic credentials and knowledge of Income Tax and other matters, are eligible to apply for the position. The empanelment will be for a period of two years, and the payment of fees will be governed by the instructions issued by the CBDT, Government of India, from time to time.
As per the eligibility conditions given in Annexure-I to the above-mentioned instructions, advocates with a minimum of five years of experience in handling Direct Tax matters before High Courts or ITAT can apply for Senior Standing Counsel, while those with a minimum of three years of experience can apply for Junior Standing Counsel. The applicants should also have basic knowledge of working with computers and online formats. The last date for receipt of applications is 12.05.2023 by 4 p.m., and applications found to be deficient in any respect will be summarily rejected.

To be eligible, a person should have a minimum of five years of experience handling direct tax matters before High Courts or ITAT as an advocate. Alternatively, they should have served as a Junior Standing Counsel for three years or should have been an officer of the Income-tax Department eligible to appear before the High Court as an advocate and retired or resigned from the post of Addl. Commissioner/Director of Income-tax or an equivalent post after occupying such a post for at least three years. Additionally, they should not have been removed/dismissed or compulsorily retired from service due to disciplinary action, and no disciplinary proceeding under service rules or pension rules should be pending against them.
The eligibility criteria for engagement as Junior Standing Counsel are comparatively relaxed. To be eligible, a person should have a minimum of three years of experience handling preferably direct tax matters before High Courts or ITAT as an advocate. Alternatively, they should have been an officer of the Income-tax Department retired or resigned from the post of Additional/Joint CIT or below and eligible to appear before the High Court as an advocate, provided they have not been removed/dismissed or compulsorily retired from service due to disciplinary action, and no disciplinary proceeding under service rules or pension rules is pending against them.
As per Income Tax Department Recruitment 2023 official notification, the selection process for engagement of Standing Counsels involves calling for applications through advertisement in national and local newspapers as well as the Bar Association of the High Court. A Screening Committee, headed by the CCIT and including at least two Officers not below the rank of PCIT/PDIT/CIT/DIT and CIT (1), evaluates the proposals received.
The Committee examines the applicants’ expertise in handling direct tax matters, aptitude for interpretation, and suitability to represent the Department in an interview conducted for the purpose. An evaluation report, along with a recommendation of the CCIT, is sent to the Board in Proforma-B. The engagement of panel shall normally be for a period of three years. Senior Standing Counsels should preferably be taken from among the panel of Junior Standing Counsels of at least three years standing, subject to favorable assessment by the Screening Committe
As per Income Tax Department Recruitment 2023 official notification, the duties of a Standing Counsel include drafting Memorandum of Appeals and related petitions/applications within a reasonable time, filing appeals/other petitions/applications within the limitation period and communicating the particulars to the concerned party, rectifying defects/office objections in the appeals etc. with the assistance of the PCIT/CIT, representing the department in the High Court and other judicial forums as required, keeping the PCIT/CIT informed of important developments in the case, applying for a certified copy of the judgment within two working days of pronouncement, and giving an opinion regarding the advisability of filing an appeal against such a decision within three days of taking delivery.
The Standing Counsel must also provide legal advice to the department on civil, criminal, and revenue matters pertaining to direct taxes and such matters arising in the course of administration of the department as are referred to him, perform other duties of legal nature assigned to him by the department, and submit a monthly report.
