IndiGo Airlines, India’s largest carrier, has received a tax notice of Rs. 944.20 crore for the assessment year 2021-22. The airline stated that the issue comes from an assessment order under Section 143(3) of the Income Tax Act, which was dismissed but is still under review.
IndiGo has strongly opposed the notice, calling it incorrect and baseless. The airline plans to challenge the decision legally, arguing that the ruling does not comply with current tax laws.
"The penalty order under Income Tax was issued due to a mistaken belief that IndiGo’s appeal before the Commissioner of Income Tax (Appeals) against the assessment order under Section 143(3) was dismissed, while it is still active and under review. IndiGo firmly believes that the order is incorrect and not in line with the law. The airline will challenge it and pursue appropriate legal action," said an IndiGo spokesperson.
"The Income Tax Authority has imposed a penalty of Rs. 944.20 crore for the assessment year 2021-22. This order is based on a mistaken belief that IndiGo’s appeal before the Commissioner of Income Tax (Appeals) [CIT(A)] against the assessment order under Section 143(3) was dismissed, while it is still active and under review," IndiGo stated in its filing.
IndiGo asserts that the tax demand will not significantly impact its financial health, operations, or business activities. While the exact financial implications are uncertain, the airline believes the order will not materially affect its performance.
"The company firmly believes that the order issued by the Income Tax Authority is incorrect, unlawful, and baseless. Therefore, IndiGo will challenge this and take appropriate legal action. As a result, this order does not have any significant impact on the company’s finances, operations, or other activities," IndiGo stated in its filing.
