MCA notifies Amendment in Tribunals Reforms Act 2021

The Ministry of Corporate Affairs(MCA) has notified Amendment in Tribunals Reforms Act 2021 via issuing Notification.

The Notification Stated as, “In exercise of the powers conferred by section 3 of the Tribunals Reforms Act, 2021 (33 of 2021), the Central Government hereby makes the following rules to amend the Tribunal (Conditions of Service) Rules, 2021.”

These rules may be called the Tribunal (Conditions of Service) Amendment Rules, 2023. They shall come into force on the date of their publication in the Official Gazette.

In the Tribunal (Conditions of Service) Rules, 2021, in rule 5, after sub-rule (2), the following sub-rule shall be inserted, namely:-

“(3) Notwithstanding anything contained in rule 3, a person holding or has held the post of Chairperson or Member, as the case may be, of any Tribunal shall be eligible for re-appointment.’’
