1st Post: Judicial Member: 03 Vacancies

Vacancy Occurrence Dates: 09.10.2022, 23.10.2023 and 21.01.2024

2nd Post: Technical Member: 02 Vacancies

Vacancy Occurrence Dates: 22.01.2024, 14.02.2024

Monthly Pay under NCLAT Recruitment 2023:

The Monthly Pay in accordance with the NCLAT Recruitment 2023 Official Vacancy Circular for Judicial Member and Technical Members may be read as narrated hereunder:

Monthly Pay: Rs. 2.25 Lac (Consolidated)

Salary and Allowances {Rules 10 and 11 of the Tribunal(Conditions of Service) Rules 2021}: The Member shall be entitled to a Monthly Salary Rs. 2.25 Lac (Rupees Two Lac Twenty-Five Thousand) Per Month plus Other Allowances as admissible.

Office Tenure: {Section 5 of the Tribunals Reforms Act 2021}: Every Member of the Tribunal shall hold Office and continue for 04-Years’ Term or till he/she attains the Age of 67 Years, whichever is earlier.

Maximum Age Limit for NCLAT Recruitment 2023:

According to the NCLAT Recruitment 2023 Official Vacancy Notice, the Maximum Age Limit for BOTH Posts Judicial Member and Technical Members, as on the Closing Date for receipt of the duly completed Applications on 17.07.2023 should be as mentioned hereunder:

Age Limit: Not to exceed 50 Years

Eligibility for NCLAT Recruitment 2023:

The Eligibility for NCLAT Recruitment 2023 Official Vacancy Circular for Judicial and Technical Members should have gained the Eligibility Criteria explained hereunder:

Educational and Professional Qualifications and Other Terms and Conditions: The Qualifications, Eligibility, Salary and other Terms and Conditions of the Appointment of any Candidate will be governed by the Provisions of the Tribunals Reforms Act 2021 and the Tribunal (Conditions of Service) Rules 2021. The Main Terms and Conditions are following:

i) Qualifications {Sub-Rules 11 of Rules 03 of the Tribunal (Conditions of Service) Rules 2021):

01: Judicial Member Post:

a) is or has been, a Judge of any High Court; Or

b) is a Judicial Member of the National Company Law Tribunal for 05 Years; Or

c) has been an Advocate for 10 Years with Substantial Experience in Litigation in matters relating to Company Affairs before the National Company Law Tribunal, National Company Law Appellate Tribunal, High Court, Or Supreme Court.

02: Technical Member Post:

Any Person of Proven Ability, Integrity, and Standing having Special Knowledge and Professional Experience of Minimum 25 Years in Law, Industrial Finance, Industrial Management Or Administration, Industrial Reconstruction, Investment, Accountancy or any other matter, which is useful to the National Company Law Appellate Tribunal.

Selection Process under NCLAT Recruitment 2023:

The Selection Process for Both Judicial Member and Technical Member Positions under NCLAT Recruitment 2023:

Selection Procedure:  The Search-Cum-Section Committee constituted under the Tribunal Reforms Act 2021 for recommending the names for Appointment to the Notified Post(S) shall conduct a Scrutiny of the Applications with respect to  Suitability of Application for the Posts by giving due Weightage to the Qualifications and Experience of the Candidates and shortlisting Eligible Candidates for conducting Personal Interaction.

Final Selection for the Post(s) will be carried through based on the Overall Evaluation of Candidates done by the Committee based on Qualification, Experience, and Personal Interaction.
