Tax Audit Update: 6 PILs filed in various High Courts seeking Due Date Extension

As the due date of filing the Tax Audit Report approaches, many professional bodies and taxpayers are requesting an extension, citing several portal glitches. Since the government is not responding to these requests, CAs and other tax bodies across the country are now filing Public Interest Litigations (PILs) and writ petitions, hoping for an extension of the due date to file the Tax Audit Report for the Financial Year 2024-25 (Assessment year 2025-26).

The common difficulties cited by the professionals and taxpayers, other than the portal glitches ,include the heavy rainfall and floods in some regions of the country, which affected the availability of internet and electricity, affecting the audit work. Apart from this, the festive season (Navratri) has also reduced working days due to holidays. These writ petitions are requesting relief for all the affected taxpayers. Here is the update on these PILs:

  • Jodhpur Tax and & Association: The case is listed for 24th September 2025 in the Rajasthan High Court.
  • Bhilwara Tax & Bar Association: This one is also listed for 24th September 2025 in the Rajasthan High Court.
  • Punjab and Haryana High Court (Ashwini Kumar v. Central Govt.): the case was heard today, and the High Court has ordered the Department counsel to get instructions from CBDT by September 26, 2025, i.e., the next hearing; otherwise, the court will pass suitable orders.
  • RTCA (Rajasthan Tax Consultants Association): The petition has been filed, and the hearing date is awaited.
  • ITBA (Income Tax Bar Association) Ahmedabad: The Special Leave Petition (SLP) has been filed at the Gujarat High Court today, and the information of the case is still awaited.
  • Delhi TBA – W.P.(C) 14691/2025 – Heard today; Dept to seek instructions. Next hearing on 24.09.2025

With the increasing number of PILs and Writ Petitions, the high court is expected to consider the genuine problems of the taxpayers and offer the much-needed relief.
