CBIC to soon adjudicate MRF, Bombay Dyeing and Vedanta for Evasion on Imports

The Central Board of Indirect Taxes and Customs(CBIC) intends to adjudicate show cause notices issued to importers for Integrated GST evasion soon, as per reports. This will have an impact on major importers such as Bombay Dyeing, BALCO, Vedanta, JSW Steel, and MRF.

Furthermore, after the April 28 Supreme Court ruling, CBIC has issued directives to Directorate of Revenue Intelligence (DRI) field formations to initiate adjudication in cases of misuse of pre-import and physical export conditions.

In a recent decision, the Supreme Court determined that the Advance Authorization scheme requires export to occur after raw material import to qualify for IGST benefits. According to the ruling, items must first be imported and used in the production of final products that will be exported rather than sold locally.

Additionally, DRI Kolkata expects to recover around Rs.2165 crore from importers, with the duty amounting to Rs.935 crore, the interest amounting to Rs 701 crore, and the penalty amounting to Rs.529 crore. DRI’s Kolkata Zonal Unit has launched a probe into more than 150 importers accused of IGST evasion using the Advance Authorization programme.
