The Ministry of Labour and Employment has authorised designated officials to regulate and initiate prosecution proceedings under the Code on Social Security, 2020 within their respective jurisdictions.

Govt Authorises officers who can initiate legal action for contraventions under Social Security Code, 2020
The Ministry of Labour and Employment under the Government of India has authorised several officials appointed under subsection (7) of Section 24 of Chapter IV of the Social Security Code, 2020, to regulate the initiation of prosecution proceedings under the said Code.
The Central Government has taken this decision in exercise of its powers granted under Section 137 of the Code on Social Security, 2020 (36 of 2020), and officially announced it through a Notification No. S.O. 2361(E), dated May 08, 2026.
The provisions of the said section provide the government authority to decide which officers can initiate legal action for contraventions under the law. This move is aimed at streamlining the process of starting prosecution proceedings under the said Code.
In reference to the notification, the officials, including the Insurance Commissioner, Additional Commissioner, Regional Director Grade ‘A’/Director, Regional Director Grade ‘B’/Joint Director, Deputy Director, Assistant Director, etc., have been empowered for the purposes of regulating the initiation of prosecution proceedings under the Social Security Code, 2020.
The powers granted to these officials will apply only within their respective territorial and functional jurisdictions. Meaning, no officer can exercise this authority outside the area and role assigned to them by the government.
