CESTAT issued Procedure for Requesting Physical Hearing, Delhi effective 29th Nov 2021
The Customs Excise and Service Tax Appellate Tribunal ("CESTAT"), Delhi, released Public Notice No. 1 of 2021 on November 15, 2021, regarding the procedure for electing for physical hearings beginning November 29, 2021.
The Bar Associations have made representations requiring physical hearings of appeals. As the pandemic situation improves and the higher courts have partially converted to a physical mode of hearing, the Hon'ble President decrees that appeals may be heard physically if the counsel so requests. Annexure I describes the listing methods and protocols that must be followed.
Any party wishing to have an appeal heard in person may send a request to the Registry by e-mail, as specified in Annexure II. Request forms submitted from Monday to Thursday will be scheduled for hearing in the following week in order of seniority, subject to a maximum of six items per day, according to the roster. The appeal for which a request for physical hearing has been made should otherwise be due for hearing in its normal turn, unless an early hearing was granted by separate order or as directed by higher courts.
For the time being, physical hearings of appeals for Division Bench proceedings will take place on Mondays and Fridays, with other appeals taking place on Tuesdays, Wednesdays, and Thursdays, and will apply solely to the Principal Bench in Delhi. On the remaining days, cases would be heard via virtual hearing mode, as they are now.
This Notification comes into force with effect from November 29, 2021.
