MCA Notifies MGT-3 to be Certified by CA, CS and CMA The Ministry of Corporate Affairs(MCA) has notified the Companies (Management and Administration) Amendment Rules 2023. This rule shall come into force with effect from 23rd January, 2023. MCA revised the form MGT-3 in the Companies (Management and Administration) Rules, 2014 to require certification by Chartered Accountants, Company Secretaries, and Cost Accountants. MGT-3 is a notice of situation, change of situation, or discontinuance of a situation, of the location where the foreign register shall be held. The professionals shall declare in the said form that he has verified the particulars (including attachment(s)) from the original/certified records maintained by the Company/applicant that are the subject matter of this form and found them to be true, correct, and complete, and that no information material to this form has been suppressed. The provisions of Sections 448 and 449 of the Companies Act 2013 which, respectively, set forth punishment for false statement/certificate and punishment for false evidence. On the basis of the company's assertion of correctness and through electronic means, this e-Form has been added to the registrar of companies' electronic database.
