Government Clarifies PAN Linking Process for EPFO Establishments

The Ministry of Labour and Employment, Govt of India, recently clarified regarding linking PAN to the Establishment Profile and the introduction of new functionality for manual verification of the PAN of the proprietor.

The government recently added a new feature on the EPFO employer portal to link the PAN of an establishment with its profile. When an employer enters the PAN, the system checks whether the establishment name in EPFO records matches the name in the Income Tax database. If both names match, the PAN is automatically linked.

The government further clarified the following:

  • In the case of proprietorship, the PAN of the owner must be used. Before linking, the employer needs to update Form 5A with the owner’s information exactly as it appears on the PAN. Once this is done correctly, the PAN can be linked successfully.
  • For branch offices, if the branch’s name differs from the main establishment’s, the main establishment must first declare all its branches, along with their code numbers, on Form 5A. The branch can only link the main establishment’s PAN after this
  • For establishments run by a society, trust, or cooperative, the EPFO office must first update the type of establishment in the system (like “Registered Society” or “Run by Trust”) using the “modify details” option before PAN linking.

If there’s a discrepancy, the system asks the employer to enter the name exactly as per PAN. It then checks again with the Income Tax database. Once the name is validated, this corrected name is stored in a different table for record purposes.

The government added that it has been observed that most mismatches are very small, such as spelling mistakes, abbreviations, or punctuation differences. To handle this, a new option is given to EPFO field offices. They can now manually verify and approve such minor mismatches instead of rejecting them.

Officers, however, are required to ensure that any discrepancies are insignificant, not substantial. Should the situation warrant, they can request additional documentation prior to approving. Furthermore, a brief justification for either approval or denial must be entered into the system.
