Income Tax Exemption given to Real Estate Regulatory Authority Jaipur U/S 10(46)
The Central Board of Direct Taxes (CBDT) under the Ministry of Finance (Department of Revenue) recently shared a notification on September 22, 2025, regarding income tax exemption.
In powers given by Section (10) clause (46) of the Income-tax Act, 1961 (43), the Central Government notifies the 'Real Estate Regulatory Authority,' Rajasthan, Jaipur. It is an authority established by the Rajasthan State Government in respect of the following mentioned income arising to the Real Estate Regulatory Authority:
(i) Amount received as grant-in-aid or loan/advance from government;
(ii) Fee/penalty received as per the provisions of 'The Real Estate (Regulation and Development) Act, 2016' (No. 16)
(iii) Interest earned on (i) (ii) above
2.This notification will be effective subject to conditions that the 'Real Estate Regulatory Authority' of Jaipur, Rajasthan-
(i) Will not be involved in any commercial activity
(ii) Activities and the nature of the specified income will remain unchanged the throughout the financial years, and
(iii) Will file return income in accordance with the provision of Section 139 (4C) and clause (g) of the Income-tax Act, 1961.
3.This notification will be deemed to have been applied for assessment years 2023-24 to 2025-26, relevant for the financial years 2022-23 to 2024-25, and will be applicable for assessment years 2026-27 to 2027-28, relevant for the financial years 2025-26 to 2026-27.
