Facts of the case

The petitioner, Divya Naresh Ramchandani, faced accusations under Sections 20, 23, and 29 of the NDPS Act, 1985, after being stopped by the Air Intelligence Unit at Rajiv Gandhi International Airport in Hyderabad on 10.04.2026 while coming from Bangkok.

Based on profiling suspicions, the authorities searched her checked luggage and reportedly found 1000 grams of a substance believed to be ganja hidden in vacuum-sealed packets among her clothes, which is classified as an intermediate quantity. She was arrested that same day and has been in judicial custody, insisting on her innocence and claiming she was falsely implicated. She later applied for bail, arguing that a significant portion of the investigation had already been completed.

Whether the petitioner, who was accused of offenses under the NDPS Act involving 1000 grams of a substance suspected to be Ganja/Marijuana, be granted bail, despite the confiscated substance being classified as ‘intermediate’?

Decision of the Court

The Telangana High Court granted bail to the petitioner, noting that she had been in custody since April 10, 2026, and that the seized substance of 1000 grams is considered only an intermediate quantity.

For her release, she must provide a personal bond of ₹15,000 along with two people as sureties for the same amount. She is also required to report to the authorities every Wednesday for eight weeks, or until the charge sheet is filed, whichever happens first, and must follow all the legal conditions under Section 480(3) of the BNSS.
