Many taxpayers postpone filing their Income Tax Return (ITR) every year thinking they can file it later without any significant trouble. Taxpayers can file a belated return even after the due date, but it will involve additional costs and loss of certain tax benefits.
If you haven't filed your Income Tax Return for FY 2025-26 (AY 2026-27) by the due date, here are the important things you need to know.
What Happens If You Miss the ITR Filing Due Date?
Taxpayers may be subject to a late filing penalty and in some cases, interest on the unpaid tax after the due date. Also, if you file late you might lose tax breaks that are only available to those who file on time.
Penalty u/s 234F for late filing
Section 234F of Income-tax Act: Penalty for not filing ITR by the due date will depend on the total income of the taxpayer.
Late Filing Fee
Total Income | Late Filing Fee |
Up to Rs 5 lakh | Rs 1,000 |
Above Rs 5 lakh | Rs 5,000 |
Below the basic exemption limit | No late filing fee |
Example
If your taxable income is Rs 7.80 lakh, you will have to pay a Rs 5,000 late filing fee if you file after the due date.
If your taxable income is Rs 4.75 lakh, the late filing fee will be Rs 1,000.
Taxpayers whose income is below the basic exemption limit generally do not have to pay the late filing fee, unless they are required to file a return under specific rules.
Interest Under Section 234A May Increase Your Tax Bill
The late filing fee is not the only expense.
If you have tax outstanding after the due date you are required to pay interest on the outstanding amount under Section 234A.
Interest is charged at 1% per month or part of a month, from the original due date until the return is filed.
Sometimes even a few days delay into the next month can incur interest for the whole month. Leaving it to the last minute could end up costing taxpayers with a large self-assessment tax bill a lot more.
Late Filings Can Cost More Than Your Wallet
Filing your return late can also lead to other financial difficulties.
Carry Forward of Losses Loss of Business
If you file your ITR after the due date then you may lose the benefit of carrying forward certain losses to future years.
They are:
Business losses
Short term capital losses
Net long-term capital losses
This means you may need to pay more tax in future years as you cannot use these losses against future income.
Loan or Visa application problems
Income Tax Returns are often required as proof of income by banks, financial institutions and foreign embassies.
Late filing may cause difficulties with applying:
Home loans
Business loans
Education loans
Credit cards
Tourist visas
Student visas
Regular and timely ITR filing also helps build a strong financial record.
Late Income Tax Refunds
In case you have paid extra tax as TDS or advance tax, your refund will be processed only after you file your Income Tax Return.
The longer you wait to file, the longer it could take before you get your refund.
Can You Still File Your Return?
Yes.
If you miss the original deadline, you can file a delayed Income Tax Return as per the rules under the Income-tax Act.
The last date for filing belated return for FY 2025-26 (AY 2026-27) is December 31, 2026.
However, it is not advisable to wait until the final days as technical issues, missing documents or failure to make payment could further delay the process.
How to Save the Additional Cost
The sooner you file your return, the better it will be to lessen the additional financial burden, if the deadline for filing your return has passed.
Before you file, you must:
Don’t delay in filing your ITR.
Verify your Form 26AS, Annual Information Statement (AIS) and Taxpayer Information Summary (TIS).
Calculate and pay any self assessment tax due.
Check TDS details in Form 16 or Form 16A.
Retain all supporting documentation for future use.
The sooner you file your Income Tax Return , the less is your interest liability on any unpaid tax and the sooner your refund, if any, can be processed .
